5_Year Limited Warranty
Seller warrants to Buyer that the goods will be free from defects in material and workmanship under normal use and service for five (5) years after the date of delivery. If Buyer is a dealer in the goods, this warranty may be transferred from Buyer to the first person that purchases the goods from the dealer. Otherwise, this warranty is not transferable, voluntarily or involuntarily or by operation of law, and any purported transfer from the original buyer shall be void. This warranty is void if the goods are used for any purpose other than the purpose for which Buyer represented they would be used at the time of sale. This warranty is void if Seller’s name, serial number or other identification marks have been defaced, damaged or removed, and is void in cases of damage in transit, negligence, abuse, abnormal usage (including use or storage in conditions of high heat, high moisture or extreme temperature changes), misuse, casualty, modification, or improper installation, maintenance or cleaning. Glass, Upholstery fabrics, and normal wear and tear, including but not limited to normal aging and wear of finishes and filling materials, are excepted from this warranty.
AS BUYER'S EXCLUSIVE REMEDY UNDER THIS WARRANTY, SELLER, AT SELLER’S OPTION, WILL REPAIR OR REPLACE ANY DEFECTIVE GOODS OR WILL REFUND THAT PORTION OF THE ACTUAL PURCHASE PRICE PAID FOR SUCH GOODS. A REPLACEMENT UNIT WILL BE THE SAME OR SIMILAR IN COLOR, DESIGN, STYLE AND QUALITY TO THE UNIT REPLACED. NOTWITHSTANDING ANYTHING TO THE CONTRARY, THERE IS NO OTHER EXPRESS WARRANTY RELATING TO THE GOODS AND SELLER DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF FITNESS FOR ANY PARTICULAR PURPOSE AND MERCHANTABILITY. Seller will not pay for or be responsible for the removal, re-installation or disposal of the goods or any replacement goods. Seller will reimburse freight charges incurred by Buyer in returning goods to Seller under this warranty, but only if the shipment has been specifically authorized by Seller in writing and the goods are found by Seller to be defective and otherwise qualified for a remedy under this warranty. Replacements and repairs made under this warranty are warranted for the remainder of the original warranty period applicable to the original product. Only an officer of Seller can modify this warranty or give any further warranty, and an officer can only do so by a written instrument signed by the officer. All other modifications or further warranties are void.
